Amicable Divorce Process

Collaborative law is based on an agreement between both parties and their attorneys to privately and amicably settle divorce issues outside of court. This method allows parties to have control over their divorce agreement in an efficient and cost-effective manner.

What Is Collaborative Law?
Collaborative law is an ADR method that is geared toward nonlitigious divorce. In collaborative law, both parties and their attorneys sign an agreement to settle out of court. Professionals such as financial planners, estate planning consultants and mental health professionals are often brought into the forum to assist with decision making in certain aspects of the divorce. The commitment to settle out of court provides each party with peace of mind that the divorce will not become litigious.

Once the parties come to an agreement, it is filed with the court for approval. Keep in mind that if either party decides to drop out of the collaborative process, then both attorneys from both sides must drop out and are not allowed to represent in any subsequent litigation.
