Houston Divorce Modifications Attorney
Material and Substantial Change in Circumstances
Even if your divorce order has been finalized, that does not mean the order is forever permanent. Divorce orders are modifiable. Circumstances in life are guaranteed to change; therefore, the law provides for them. However, modifications are only granted if there has been a material or substantial change in circumstances. Situations that often warrant a modification include job loss or relocation to another state.
At the Law Offices of Judith E. Blanchard, P.C., I assist my clients with divorce modification issues. Whether you are seeking a divorce modification or contesting a former spouse's petition for modification, I can help you. Arrange a consultation at your earliest convenience by contacting my firm.
Child Support and Spousal Support
Child support modifications are fairly straightforward in requesting, as long as there has been a material change in circumstances. This often includes remarriage, gaining employment, loss of employment, lay-off or change in a child's needs such as a medical condition. Proof can be provided through financial statements such as bank records and W-2 forms.
Spousal support modifications are similar to child support modifications in that there must be a substantial change in circumstances shown financially.
Child Custody and Visitation
Anytime child custody and visitation is examined, the most important standard is the best interests of the child. This standard continues to hold true for child custody and visitation modifications. A common reason for modification is the relocation of one parent to another state. If there have been any incidents of domestic violence, drug or alcohol abuse, it is especially critical to seek a modification as soon as possible.
Division of Marital Property
Marital property agreements can be modified; however, it is rare. Usually, they are only modifiable if there is a showing of unfairness or incompetency by the attorney who represented a party at the time of the divorce decree.
